R v Maglovski (No 2) [2013] NSWSC 16 (4 February 2013)The case FACTOn 15 November 2012, Dragi Maglovski was found guilty of the murder of his wife Rosa Maglovska. This sentence was handed down following a 7-day hearing in the Supreme Court of New South Wales. Ms Maglovska's murder was the result of 10 stab wounds and 37 stab wounds, all inflicted by Mr Maglovski. The wounds were inflicted with a knife taken from the couple's kitchen. Maglovski has pleaded not guilty to the murder charge, but pleaded guilty to manslaughter with the defense of provocation. In the months before her death Mrs Maglovska had become increasingly independent and on the day she decided to leave Mr Maglovski she allegedly spat in his face and told him she no longer wanted to live with him. . The ensuing brawl resulted in the death of Mrs Maglovska. After his wife's death, Mr Maglovski, very calm and collected, called the number '000' and then showed the crime scene to the emergency services officer. During the trial Mr. Maglovski spoke a little in the courtroom about his culture, he explained that in his culture behavior like that of his wife would require a “ritual cleansing of the family from shame”. Neither this, nor other mitigating factors, were however sufficient to reduce Dragi Maglovski's charge to manslaughter, and he was charged with the murder of his wife, Mrs Maglovska. He was sentenced to 20 years in prison, with a period of non-parole. of 16 years, on the condition that "married women have the right to choose their own destiny".
