The Ontario Provincial Police serves the Province of Ontario in many capacities, including traffic safety (Ontario Provincial Police, 2009). Traffic safety is essential for a safe society; However, when a member of law enforcement departs from law enforcement practices resulting in an unjustified charge against a civilian, are the people of the province of Ontario safer? This issue can be examined in the case R. v. Harrison, as Constable Bertoncello of the Ontario Provincial Police conducted a traffic stop on Bradley Harrison, which was not warranted. Harrison was only stopped because he had a rear license plate, however the vehicle was registered in the province of Alberta, making it legal (R. v. Harrison, 2009). The police officer justified his actions to the Supreme Court of Canada by insisting on the importance of upholding police integrity in the public eye, and this routine traffic stop led to the search and seizure of cocaine and the charge of driving with a suspended license. (R. v. Harrison, 2009). This was not sufficient motivation for Bertoncello's actions according to the Supreme Court of Canada ruling. An examination of the evidence presented before the Supreme Court of Canada in R. v. Harrison, including violations of the Canadian Charter of Rights and Freedoms, previous cases and police investigative procedures along with legal proceedings will rationalize the court's ruling for excluding narcotic paraphernalia for the trafficking charge.
