Within the United States criminal justice system, issues related to jurisdictional issues are quite common for several reasons. The case of United States v. Thomas J. L Smiley and the case of United States v. Jared Lee Loughner both had jurisdictional issues. Smiley and several other men obtained permission via a license from Mexico to search for treasure on an expedition; the treasure belonged to the steamer Golden Gate, which belonged to the US-based Pacific Mail Steamship Company. Eventually, federal charges were brought against him by the United States for violating a law regarding plundering a sunken and/or abandoned ship. In contrast, Loughner was indicted by the United States on federal charges as a result of his shooting, which resulted in the wounding and death of federal officials and employees. Furthermore, both cases involve questions of jurisdiction that concern the fairest of trials and the location of the alleged crime; however, both differ due to the circumstances and nature of the alleged crimes. The defendant in the case of United States v. Jared Lee Lougher was charged in federal court with attempted assault and attempted murder of federal employees, following his shooting at the Safeway supermarket, located in Tucson, Arizona. The shooting occurred on January 8, 2011, and left six people dead and 13 injured; the alleged target of the attack was said to be “[Representative] Gabrielle Giffords,” who was among the injured (Audi, 2011).
